1. Who We Are

nfnty is an AI-powered brand identity platform operated by Infinity Design Studio. We provide logo generation, presentation design, and related creative services to individuals and businesses worldwide.

2. Acceptance of Terms

By creating an account or using any part of nfnty you confirm that you are at least 18 years old, that you have read and understood these terms, and that you agree to be bound by them. If you are using nfnty on behalf of a company or organization you confirm that you have the authority to bind that entity to these terms.

3. Our Services

nfnty provides the following services:

AI Logo Generation: Users input brand details and our platform generates logo concepts using artificial intelligence. Outputs are delivered as digital files in formats including PNG, JPG, SVG, and PDF depending on the user's plan.

AI Presentation Design: Users input content and brand details and our platform generates branded presentation files delivered in PPTX and PDF formats depending on the user's plan.

Human Designer Review: Users on eligible plans or who purchase the add-on service may submit their generated files for review and refinement by our professional design team. Refined files are delivered to the user's email address within 48 hours of the request being accepted.

4. Account Registration

To access most features of nfnty you must create an account. You agree to provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at hello@nfnty.ai if you suspect any unauthorized use of your account.

5. Subscriptions and Payments

Subscription Plans: nfnty offers free and paid subscription plans. Paid plans are billed on a monthly basis through our payment processor Paddle. By subscribing to a paid plan you authorize recurring monthly charges to your payment method.

One-Time Purchases: Certain features including the Human Designer Review add-on are available as one-time purchases billed at the time of the transaction.

Price Changes: We reserve the right to change our subscription prices with at least 30 days notice. Price changes will take effect at your next billing cycle following the notice period.

Failed Payments: If a payment fails we will notify you by email. Your account may be downgraded to the free plan if payment cannot be collected within 7 days of the failed charge.

6. Cancellation and Refunds

Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to your paid plan features until that date.

Refunds: We offer a 7-day refund on monthly subscription payments if you are not satisfied with the service. Refund requests must be submitted to hello@nfnty.ai within 7 days of the charge. One-time purchases including the Human Designer Review add-on are non-refundable once the service has been delivered or work has commenced.

Free Plan: The free plan may be cancelled or terminated at any time without notice.

7. Intellectual Property and Ownership

Your Content: You retain ownership of all content you upload to nfnty including text, documents, logos, and reference files. By uploading content you grant nfnty a limited license to use that content solely for the purpose of providing the services you have requested.

Generated Outputs: On paid plans (Professional and Brand) all logos, presentations, and other files generated for you by nfnty are owned by you upon download. You receive full commercial rights to use these outputs in your business including on websites, marketing materials, packaging, and advertising.

Free Plan Outputs: Outputs generated on the free plan are watermarked and licensed for personal and non-commercial use only. Commercial use of free plan outputs is not permitted.

nfnty Platform: The nfnty platform, including our website, software, design system, Strategic Logic Layer, and all proprietary technology, remains the exclusive property of Infinity Design Studio. You may not copy, reverse engineer, or attempt to replicate our platform or systems.

8. Prohibited Uses

You agree not to use nfnty to:

• Generate content that is illegal, defamatory, obscene, or infringes the intellectual property rights of any third party.
• Attempt to generate logos or designs that are intentionally similar to existing trademarks for the purpose of deception or infringement.
• Upload content that contains malware, viruses, or any code designed to harm our systems or other users.
• Use automated tools, bots, or scripts to access or scrape nfnty without our express written permission.
• Resell or sublicense access to nfnty to third parties without our written consent.
• Attempt to circumvent or disable any security features or usage limits of the platform.

9. Human Designer Review Service

When you request a Human Designer Review you acknowledge the following:

• Delivery is estimated within 48 hours of the request being accepted during business days. Requests submitted on weekends or public holidays will be processed on the next business day.
• The service includes one round of revisions based on the notes and references you provide at the time of submission. Additional revision rounds may be requested at additional cost.
• Our design team will make reasonable efforts to fulfill your request but the final output is subject to design judgment and professional standards. We do not guarantee that the final output will match any external reference exactly.

10. Disclaimer of Warranties

nfnty is provided on an as-is and as-available basis. We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any output generated by our platform. AI-generated outputs are probabilistic in nature and results may vary between generations.

We do not guarantee that logos or other outputs generated by nfnty will be free from similarity to existing designs or trademarks. You are responsible for conducting your own trademark clearance search before using any generated design commercially.

11. Limitation of Liability

To the fullest extent permitted by applicable law, nfnty and Infinity Design Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of profits, loss of data, or business interruption.

Our total liability to you for any claim arising from your use of nfnty shall not exceed the total amount you have paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless nfnty and Infinity Design Studio from any claims, damages, losses, or expenses including legal fees arising from your use of the platform, your violation of these terms, or your infringement of any third party rights.

13. Privacy

Your use of nfnty is also governed by our Privacy Policy available at nfnty.ai/privacy. By using nfnty you consent to the collection and use of your information as described in the Privacy Policy.

14. Changes to These Terms

We may update these Terms of Service from time to time. When we make material changes we will notify you by email or by displaying a notice on the platform. Your continued use of nfnty after the effective date of any changes constitutes your acceptance of the updated terms.

15. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of nfnty shall be subject to the exclusive jurisdiction of the courts of England and Wales.
